RESERVATIONS

We refer to the Person who makes the booking as the Customer. Think of him/her as the captain at the front of a plane, taking responsibility, calling the shots on behalf of everyone else, any guests he/she brings.


Except at the discretion of Cloud View Garden, reservations and tentative bookings do not constitute any commitment by us to accept your Accommodation request
All Bookings must contain the correct number of guests.

We require photo ID for the Customer in order to accept the booking.

Our Safety and Security Policy requires the name and address of every other guest attending. Where such number must not exceed the maximum capacity of the Accommodation. We reserve the right to charge additional fees for additional guests.


During Peak Periods, we may impose different payment requirements and amounts in respect of Fees/Deposits, different cancellation terms and other terms as advised by us.


We reserve the right to impose minimum night stay requirements at any time.

CHECKIN - CHECKOUT

We’ll be ready to welcome you any time from 3pm
We’ll be sad to see you go – has to be by 11am please.

INCIDENTALS - DAMAGE

The Customer is liable for any loss, damage or injury suffered by Cloud View Garden its employees, contractors and/or agents and any loss or damage caused to the accommodation, our equipment, furniture, fixtures, fittings, systems, decorations or other property to the extent that such loss, damage or injury is caused or contributed to by the Customer and/or any of its employees, contractors or guests.

YOUR SECURITY - CREDIT CARD

Cloud View Garden will hold the credit card details provided by the Customer used for the booking, securely encrypted on its system, primarily for two purposes:
1. To assist the Customer with the Purchase of any Additional Offerings e.g. mini bar, food, wine, picnic baskets, pantry items, extended time, etc., and
2. To act as a Security Bond in the event of any Damage (to the property or equipment), breakages, extra cleaning or other items or services as may be determined in accordance with any or all of these Terms and Conditions. The Customer gives authority for the deduction of any additional fees, charges or reimbursements as set out in these Terms and Conditions.

FULLY REFUNDABLE BOND

We require a $500 fully refundable Bond be provided to secure all bookings. The Bond can be provided by Credit Card or EFT. Bonds will be promptly refunded to Guests in full unless there are exceptional circumstances or by prior agreement with/authorisation by, the Guest for example where charges for items consumed, eg food, drinks, picnic baskets, etc. are offset. Refunds will be made within two Business Banking Days of check out and to the Guest's Nominated Bank account. On rare occasions, eg. where we allow Guests to bring pets, a Bond higher than $500 might be requested to confirm any such 'Special Bookings'.

CAR PARKING + YOUR GOODS

Cloud View Garden has one car space for each Retreat. If there are any additional vehicles associated with a guest/booking, they may have to park in our street. Cloud View Garden does not have storage facilities other than the Accommodation booked by the Customer.

To the extent permitted by law, in particular to the extent permitted by the Australian Consumer Law and Fair-Trading Act 2012 s 5.2, Cloud View Garden will not accept any responsibility for any damage, theft or loss of goods and valuables during your stay. In the event that we cannot exclude liability, such liability is capped at $100.
All goods must be removed at the conclusion of your stay. Any goods left without prior arrangement will be deemed abandoned.

DIRECTIONS

In the event of an emergency, the Customer and guests must follow the directions our staff to evacuate the Accommodation if instructed to do so.


USE OF ACCOMMODATION

The Customer shall conduct and use the Accommodation in a proper, orderly and lawful manner and shall not permit any act, matter or thing which could compromise the safety of any person or may injure the reputation of Cloud View Garden or cause loss or damage to any person or property and may not disrupt the quiet use and enjoyment of other guests.
We reserve the right to terminate your use of the Accommodation if an incident occurs or you, or your guests are in breach of these terms or any law. We reserve the right to remove a person/s without liability if behaviour is not considered appropriate.

ALCOHOL

In terms of any alcohol that you ask us to provide, Cloud View Garden and our staff adhere to Responsible Service of Alcohol as follows:
o Alcohol will not be sold or supplied to a person or persons under the age of eighteen years.
o Proof of age must be provided on request
o We will not permit intoxication or any indecent, violent or quarrelsome conduct on our premises.
o Alcohol will not be supplied to any person or persons who are at the time in a state of intoxication. Accordingly, Customers and guests will be denied service if they are considered to be intoxicated.

SMOKING

In the interest of public health, and in line with Government Regulations, Cloud View Garden accommodation is a smoke free venue. No smoking (including e cigarettes) is permitted on site and guests will be directed to a permitted smoking area in the open air.

LIABILITY

To the extent permitted by law, we do not accept liability to you or your guests for any liabilities, loss, damage or injury arising from or connected to the use by the Customer, its employees, contractors or guests of the Accommodation and/or the consumption of any food or beverages. Use of the Accommodation is at the Customer's own risk.

PERSONAL INFORMATION

You consent and authorise Cloud View Garden to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.
You consent to information which you have provided to us as part of your booking being used by Cloud View Garden for purpose of informing you about offers and promotions which relate to Cloud View Garden and its related bodies.
We will not provide or disclose any information you have provided to us to any person other than a related body corporate without your prior written consent.

CHILDREN

Cloud View Garden offers accommodation for adults above the age of 18 years only, to ensure all of our guests have a quiet and relaxing experience. We will consider requests for children of guests to stay with us or attend our premises for events or on special occasions only when made prior and in writing.

BREAKFAST

Cloud View Garden provides a generous range of quality continental breakfast provisions sufficient for each nights stay. We have have options as part of our ‘Additional Offerings’ capability. We can also recommend local cafes and great places to eat nearby – just ask.

PAYMENT POLICY

All packages and rates quoted are based on dual share. For more options, please contact us.
A minimum two nights stay applies. When you arrive at our property and then open the door to our accommodation, after recovering from being ‘blown-away’, you’ll understand why one night is simply just not enough! Too much to take in, fun to-be-had and escaping from the world to do to leave after just one night.
All rates are stated as ‘from’, are dependent on availability and subject to change.
To secure all reservations, full payment is required.
If your stay is extended with our agreement, we require you to pre-pay for such additional nights in advance.

IMPOSSIBILITY CLAUSE

In the event that services are impossible to fulfill due to natural disaster, state of emergency, pandemic or similar – the amount paid will act as a credit towards future stays. This credit will be valid for 12 months. No refunds will be issued. When you come back to stay in these circumstances, we will provide a cheese board and bottle of French Champagne - our gesture of goodwill in challenging circumstances.

CANCELLATION POLICY

If a booking is cancelled after it has been confirmed and where you provide such advice in writing at least 14 days prior to the booking, we will suspend the amount paid as a credit for you to use any time in the next 12 months.
Where the booking is cancelled 13-8 days out from the commencement of the stay, we will do our best to secure a booking from another guest to avoid loss of the payment made by you to secure the booking.
In the event a booking is cancelled 0-7 days out from the commencement of your stay, the full accommodation price will be forfeited to Cloud View Garden.

COMMERCIAL USE & PHOTOSHOOTS

Unless we agree otherwise, commercial use of Cloud View Garden is strictly prohibited. Whilst we are more than happy for our guests to take photographs and videos for their own, personal purposes, any commercial photoshoots at Cloud View Garden are prohibited unless we have provided prior, written approval. All filming and photography requests must be sent prior to the date of arrival, are subject to the discretion of Cloud View Garden and may be subject to additional fees.
